ViaVela Machina End-User License Agreement

ViaVela Machina End-User License Agreement

This Agreement is between ViaVela Solutions LLC ("ViaVela," "we") and the individual or entity installing the software ("you"). By installing or using ViaVela Machina ("the Software"), you accept it. If you do not accept, do not install or use the Software.
1. Licence
We grant you a non-exclusive, non-transferable, revocable licence to install and use the Software on hardware you control, for diagnosing vehicles you own or are authorized to service. You may not sublicense, resell, rent, or redistribute it, and you may not reverse-engineer it except to the extent that restriction is unenforceable under applicable law.
2. What the Software is
An offline diagnostic assistant: it reads diagnostic trouble codes, freeze frames, and live parameters from a vehicle over an OBD-II adapter, keeps a local session record, provides an AI chat aid that runs on your own machine, and displays wiring diagrams and reference material you have obtained.
It is a diagnostic aid for a qualified technician. It is not a substitute for training, for official OEM service information, or for your own judgment.
3. VEHICLE SAFETY — READ THIS
Working on vehicles is dangerous. The Software connects to a vehicle's diagnostic bus. Ordinary diagnostics — reading fault codes, live data and freeze frames, and clearing stored codes — send standardized OBD-II requests to the vehicle; clearing codes asks you to confirm first. In one specific mode described in Section 5, the Software can additionally transmit a custom actuator command to a live electronic control unit.
A wrong command sent to an ECU can move actuators, change ECU state, disable a safety system, damage the vehicle, or create a condition that injures someone. Vehicles can also move, start, or engage systems in response to bidirectional commands.
You are responsible for: verifying the vehicle is in a safe state and secured before any test; keeping people clear; knowing the correct procedure from official OEM service information; and deciding whether any command is appropriate for the specific vehicle in front of you. Never rely on this Software as the sole basis for a repair, a road-worthiness decision, or a safety-critical judgment.
4. Placeholder actuator tests are blocked, and must stay blocked
The Software contains a catalogue of bidirectional "active test" entries whose payloads are unvalidated placeholders. Execution of those entries is disabled in software and they are labelled as framework-only.
You must not modify, patch, or circumvent that block. Doing so — including by editing the Software, its configuration, or its data files — transmits guessed commands to a real ECU. If you do it, you do it entirely at your own risk, the licence granted here terminates immediately, and ViaVela disclaims all responsibility for the consequences to the fullest extent permitted by law.
5. Professional Mode — the only path that transmits a custom command
The built-in active-test entries are unvalidated placeholders and are blocked from executing. A separate, provenance-gated path allows a qualified technician to run a custom actuator command they have validated. It executes only when all of the following hold:
- Professional Mode is switched on (it is off by default);
- a licensed-technician acknowledgment has been recorded;
- the command carries complete provenance — name, vehicle applicability, the raw payload, the expected response, and a non-empty reference to official OEM service information;
- you confirm a per-run dialog showing the payload, any vehicle mismatch warning, the source reference, and the safety notes.
Every transmission is written to a local execution log before it is sent.
The provenance is what unlocks execution — not the user. ViaVela supplies the mechanism; you supply and are responsible for the payload. ViaVela does not author, verify, endorse, or warrant any command you enter, and is not responsible for what it does to a vehicle.
The Software reports the ECU response honestly. A timeout, a "no data", or a negative response is shown as such and is never presented as success.
6. AI features
The Software includes an AI chat aid that runs locally on your machine; it does not send vehicle data to a cloud service. It can be wrong, including confidently wrong. Its output is a starting point for your own diagnosis and must be checked against official service information. It never triggers a vehicle command.
7. Reference material and third-party sources
The Software can display wiring diagrams and reference data from sources you configure or obtain, and can query public vehicle-data services. ViaVela does not grant you any right to third-party manuals, diagrams, or databases, and you are responsible for holding the necessary rights or subscriptions for any material you load or access. Those sources' own terms apply to you directly.
8. Your data stays with you
The Software stores sessions, diagnostic records, and settings locally on your machine. ViaVela does not collect telemetry, usage analytics, or your vehicle or customer data, and has no remote access to your installation. You are responsible for your own backups.
9. No warranty
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SOFTWARE IS PROVIDED "AS IS" AND WITHOUT WARRANTY OF ANY KIND, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. ViaVela does not warrant that diagnostic readings, AI output, or reference material are correct, complete, or suitable for any particular vehicle.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, VIAVELA IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, VEHICLE DAMAGE, PROPERTY DAMAGE, OR PERSONAL INJURY, arising out of or relating to the Software. ViaVela's total aggregate liability is limited to [the greater of the amount you paid for the Software in the 12 months preceding the claim, or $100 — counsel to confirm].
Nothing in this Agreement excludes or limits liability that cannot lawfully be excluded or limited — including, in many jurisdictions, liability for death or personal injury caused by negligence. (Counsel: confirm the enforceable formulation for each jurisdiction of distribution; a blanket personal-injury exclusion is void in many of them.)
11. Indemnity
You will indemnify ViaVela against claims arising from your use of the Software, including any command you transmit to a vehicle, any circumvention of Section 4, and any third-party material you load without the necessary rights.
12. Term and termination
This licence continues until terminated. It ends automatically if you breach Sections 1, 4, 5, or 7. On termination you must stop using and remove the Software.
13. Open-source components
The Software includes third-party open-source components under their own licences; see [NOTICES file path — fill once the first release is cut]. Those licences govern those components and nothing here limits your rights under them.
14. Governing law
